١. قبول الشروط
باستخدامك تطبيق «مسمار» فإنك توافق على هذه الشروط. إذا كنت لا توافق عليها، يُرجى عدم استخدام التطبيق. إذا كان عمرك دون سن الرشد، فاستخدامك للتطبيق يكون بموافقة وليّ أمرك وإشرافه.
٢. وصف الخدمة
«مسمار» منصّة تعليمية تتيح:
- للطلاب: تصفّح الدورات، ومشاهدة المحاضرات المصوّرة، وأداء الاختبارات، والتواصل مع المعلّم.
- للمعلمين: إنشاء الدورات ورفع المحاضرات والاختبارات وإصدار أكواد الاشتراك وإدارة طلابهم.
قد نضيف أو نعدّل أو نوقف أي ميزة في أي وقت. لا نضمن توفّر الخدمة دون انقطاع.
٣. الحساب
- يسجّل الطالب برقم هاتفه عبر رمز تحقق يُرسل بالواتساب. أنت مسؤول عن الحفاظ على رقمك وجهازك.
- يجب أن تكون البيانات التي تُدخلها صحيحة.
- لا يجوز مشاركة حسابك أو بيعه أو السماح لغيرك باستخدامه.
- يحق لنا تعليق أو إغلاق أي حساب يخالف هذه الشروط.
٤. أكواد الاشتراك والوصول للمحتوى
- يُفتح محتوى الدورات المدفوعة عبر كود اشتراك يصدره المعلّم.
- لكل كود عدد محدود من الأجهزة المسموح بتفعيله عليها، يحدّده المعلّم. تجاوز هذا الحد يمنع التفعيل على جهاز إضافي.
- الكود مخصّص لمستخدم واحد. مشاركته مع آخرين تُعدّ مخالفة وقد تؤدي إلى إلغائه دون تعويض.
- تتم عمليات الدفع خارج التطبيق مباشرة بينك وبين المعلّم. التطبيق لا يعالج أي مدفوعات ولا يحتفظ بأي بيانات بطاقات.
٥. الملكية الفكرية
المحاضرات والفيديوهات والاختبارات وكل المواد داخل التطبيق مملوكة لمعلّميها أو لأصحاب حقوقها، وهي محميّة قانوناً. يُمنع منعاً باتاً:
- تسجيل الشاشة أو تنزيل الفيديوهات بأي وسيلة.
- إعادة نشر المحتوى أو بيعه أو مشاركته خارج التطبيق.
- استخدام المحتوى لأي غرض تجاري دون إذن كتابي من صاحب الحق.
مخالفة ذلك تعرّض الحساب للإغلاق الفوري، مع حفظ حق أصحاب المحتوى في اتخاذ الإجراءات القانونية.
٦. محتوى المعلّمين ومسؤوليتهم
- يقرّ المعلّم بأنه يملك حقوق المحتوى الذي يرفعه أو أنه مخوّل بنشره.
- المعلّم مسؤول وحده عن دقّة محتواه التعليمي وسلامته.
- تخضع مقاطع «الريلز» لمراجعة إدارية قبل ظهورها للطلاب.
- يحق لنا إزالة أي محتوى مخالف للقانون أو لهذه الشروط دون إشعار مسبق.
٧. قواعد السلوك
يُمنع أثناء استخدام التطبيق:
- نشر أي محتوى مسيء أو مخالف للآداب العامة أو للقانون العراقي.
- التحرّش بأي مستخدم أو إزعاجه عبر المحادثات.
- انتحال شخصية شخص آخر.
- محاولة اختراق التطبيق أو تعطيله أو الوصول لبيانات مستخدمين آخرين.
- استخدام برامج أو وسائل آلية لتنزيل المحتوى.
٨. الخصوصية
تُوضّح سياسة الخصوصية كيفية جمع بياناتك واستخدامها، وهي جزء لا يتجزّأ من هذه الشروط.
٩. حدود المسؤولية
يُقدَّم التطبيق «كما هو». لا نضمن خلوّه من الأخطاء أو الانقطاع، ولا نتحمّل المسؤولية عن أي أضرار غير مباشرة ناتجة عن استخدامه، بما في ذلك انقطاع الخدمة أو فقدان بيانات، إلى الحد الذي يسمح به القانون النافذ.
نحن لسنا طرفاً في العلاقة التعاقدية أو المالية بين الطالب والمعلّم، ولا نضمن جودة أي دورة أو نتيجة تعليمية معيّنة.
١٠. إنهاء الاستخدام
يمكنك التوقف عن استخدام التطبيق وحذف حسابك متى شئت بمراسلتنا. ويحق لنا تعليق أو إنهاء حسابك عند مخالفة هذه الشروط، مع إشعارك بالسبب كلما أمكن ذلك.
١١. تعديل الشروط
قد نحدّث هذه الشروط من وقت لآخر. يظهر تاريخ آخر تحديث أعلى الصفحة، واستمرارك في استخدام التطبيق بعد التحديث يُعدّ قبولاً بالشروط المعدّلة.
١٢. القانون الواجب التطبيق
تخضع هذه الشروط لقوانين جمهورية العراق، وتختص المحاكم العراقية بالنظر في أي نزاع ينشأ عنها.

1. Acceptance
By using the Mismar app you agree to these Terms. If you do not agree, please do not use the app. If you are under the age of majority, your use must be with the consent and supervision of a parent or guardian.
2. The service
Mismar is an educational platform that lets:
- Students browse courses, watch recorded lectures, take quizzes, and message their teacher.
- Teachers create courses, upload lectures and quizzes, issue access codes, and manage their students.
We may add, change, or discontinue any feature at any time. We do not guarantee uninterrupted availability.
3. Accounts
- Students register with a phone number via a WhatsApp verification code. You are responsible for keeping your number and device secure.
- The information you provide must be accurate.
- You may not share, sell, or let anyone else use your account.
- We may suspend or close any account that breaches these Terms.
4. Access codes and content access
- Paid course content is unlocked with an access code issued by the teacher.
- Each code may be activated on a limited number of devices, set by the teacher. Beyond that limit, activation on a further device is refused.
- A code is for a single user. Sharing it is a breach and may lead to its cancellation without compensation.
- Payments happen outside the app, directly between you and the teacher. The app processes no payments and stores no card data.
5. Intellectual property
Lectures, videos, quizzes and all materials in the app belong to their teachers or rights holders and are legally protected. The following are strictly prohibited:
- Screen recording or downloading videos by any means.
- Republishing, selling, or sharing content outside the app.
- Using the content for any commercial purpose without the rights holder's written permission.
Breach may result in immediate account closure, without prejudice to the rights holders' right to take legal action.
6. Teacher content and responsibility
- Teachers confirm they own the rights to the content they upload or are authorised to publish it.
- Teachers are solely responsible for the accuracy and suitability of their educational content.
- Reels are reviewed by the administration before becoming visible to students.
- We may remove content that breaches the law or these Terms without prior notice.
7. Acceptable use
While using the app you must not:
- Post content that is offensive or contrary to public decency or Iraqi law.
- Harass or spam any user through chat.
- Impersonate another person.
- Attempt to hack, disrupt, or access other users' data.
- Use software or automated means to download content.
8. Privacy
Our Privacy Policy explains how your data is collected and used, and forms part of these Terms.
9. Limitation of liability
The app is provided "as is". We do not warrant that it is error-free or uninterrupted, and we are not liable for indirect damages arising from its use, including service interruption or data loss, to the extent permitted by applicable law.
We are not a party to the contractual or financial relationship between student and teacher, and we do not guarantee the quality of any course or any particular educational outcome.
10. Termination
You may stop using the app and request deletion of your account at any time. We may suspend or terminate your account for breach of these Terms, notifying you of the reason where possible.
11. Changes to these Terms
We may update these Terms from time to time. The last-updated date appears at the top of this page, and continued use after an update constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Iraq, and the Iraqi courts have jurisdiction over any dispute arising from them.
